July 13th
Workers Compensation Insurance Legislation Issues – 10:15 a.m. -11:30 a.m.
Course Description: In this session, specific workers compensation insurance legislation issues will be discussed and considered. Topics include: a discussion on the history of the Illinois workers compensation insurance system and the most recent efforts surrounding it including Illinois House Bills 2525 and 2622; a discussion on alternatives to workers compensation for independent contractors; and a discussion on the impact that direct dispense programs have had on state workers compensation insurance systems.
Joint State-Federal Relations & International Insurance Issues – 2:00 p.m. – 3:30 p.m.
Course Description: In this session, specific legislative and regulatory issues relating to State-Federal insurance relations and International Insurance developments will be discussed and considered. Topics include: an analysis of the recently negotiated Covered Agreement which will include examining whether provisions in the Agreement will preempt State law; a discussion on the proposed Office of the Independent Insurance Advocate and whether its creation would represent a move of authority back to state insurance regulators, or a step closer to a federal insurance regulator and charter that some have envisioned; an update on Dodd-Frank reform developments and the litigation surrounding the constitutionality of the structure of the Consumer Financial Protection Bureau (CFPB); an update on the pending ACA reform legislation “The American Healthcare Act” and whether some provisions in it represent an improvement to America’s healthcare system; a review of the most recent legal developments that the International Association of Insurance Supervisors (IAIS) has taken including the development of a global Insurance Capital Standard (ICS). This session also includes a discussion and analysis of draft legislation issued by Congressmen Sean Duffy (R-WI) and Denny Heck (D-WA), “The International Insurance Standards Act of 2017” that seeks to, among other things, enhance Congressional consultation and review of international insurance agreements.

Health, Long Term Care and Health Retirement Insurance Legislation Issues – 9:00 a.m. – 11:00 a.m.
Course Description: In this session, specific legislative and regulatory issues relating to health, long term care and retirement insurance topics will be discussed including: a discussion on the problems in the areas of the healthcare industry related to network adequacy, provider directories, and balance billing, and whether the drafting of an NCOIL omnibus health Model Act would be a good solution for states to consider; a thorough discussion and analysis of the anatomy of a health insurance premium – including the primary reasons that insurance premiums are as high as they are, and proposed solutions to bring those premiums down.
National Association of Insurance Commissioners (NAIC) Dialogue – 11:15 a.m. – 12:45 p.m.
Course Description: In this session, topics discussed focus on activities within the National Association of Insurance Commissioners (NAIC) including an analysis of the constitutionality of incorporating by reference work product into state law without legislative approval; a discussion on the NAIC Travel Insurance Working group’s efforts to develop a Model Law regulating the travel insurance industry; a discussion on the latest version of the NAIC Insurance Data Security Model Law; a discussion on an update on the NAIC ceasing its efforts to draft an Unclaimed Life Insurance Benefits Model Law. This session also includes a discussion on how the work of the newly formed NAIC Innovation Task Force will impact current State insurance legislation and regulation.
Property & Casualty Insurance Legislation Issues – 2:45 p.m. – 6:00 p.m.
Course Description: In this session, specific property and casualty insurance legislation issues will be discussed and considered. Topics include: the legislative and regulatory landscape of the drone industry and how drones interact with private airspace rights; pending federal flood insurance legislation and its impact on National Flood Insurance Program (NFIP) reauthorization; an NCOIL Model Law that seeks to help solve problems associated with asbestos litigation; the insurance implications of the use of big data in autonomous vehicles; a discussion on an NCOIIL Model Towing Act that would seek to protect consumers from unscrupulous towing practices; and a review of the legal implications of the Proposed Restatement of the Law on Liability Insurance. This session also includes a presentation from Rutgers Center for Risk and Responsibility at Rutgers Law School on Essential Protections for Policyholders that provides a roadmap for states to follow in regulating homeowners insurance and a scorecard to evaluate states’ current systems of regulation.

Life Insurance, Financial Planning, and Financial Services Legislation Issues – 9:15 a.m. – 11:15 a.m.
Course Description: In this session, specific Life Insurance, Financial Planning, and Financial Services legislation issues will be discussed and considered. Topics include: updates on the litigation surrounding the Department of Labor (DOL) Fiduciary Rule, and if implemented, how the Rule will impact the industry; a discussion on the Vitality Program – an innovative life insurance solution that rewards healthy living – and how States might implement similar wellness programs; a discussion on the State legislative landscape involving life insurers notifying applicant of the right to designate a secondary addressee at the time of application; a discussion on the recently promulgated New York Department of Financial Services (NY DFS) cybersecurity regulations and how they compare with the new draft of the National Association of Insurance Commissioners (NAIC) Insurance Data Security Model Law; and a discussion on the regulations applicable to Community Banks under the Dodd-Frank Wall Street Reform Act (Dodd-Frank) and Consumer Protection Act and the Consumer Financial Protection Bureau (CFPB). This session also includes a discussion and review of the proposed law that would reform the U.S. financial regulatory system: The Financial CHOICE Act of 2017.
